Music Copyright and Funeral Livestream Recordings

How to responsibly manage recordings

A musical presentation can be very meaningful during a funeral service. A favorite song or hymn, a live performance, or a specially selected recording can help invite happy memories or express feelings that words alone don’t convey.

Foveo offers three simple options for managing access to livestream recordings that may contain copyrighted music, giving you practical tools to control availability, protect the dignity of the service, and respect the rights of music creators and rights holders.

Music copyright matters in funeral streaming and recording

When copyrighted music is included in a funeral service, funeral homes should consider whether their music licenses and permissions cover how the music will be used. Importantly, permission to play music during an in-person service does not automatically mean the same music may also be livestreamed or webcast. A separate webcasting or streaming license is generally required when copyrighted music is transmitted online.

Making the recording of a livestreamed broadcast available after the service, with copyrighted music included, creates another layer of consideration and may require additional licenses or rights that can be difficult to acquire. Foveo’s Funeral Experience Platform™ (FXP) helps your funeral home manage potential copyright risks related to livestream recordings responsibly.

How to handle funeral recordings with copyrighted music

Funeral service is never one-size-fits-all. To more easily meet the needs of individual families and help accommodate family members or guests who may have been unable to attend the original broadcast or ceremony, Foveo allows you to manage recording access in accordance with your own goals, policies, licenses, and applicable rights.

Limited Guest Access Options

All Guest Access settings are selected and controlled by your funeral home. If you choose to make a recording available to guests, you can set the type of recording and how long it is available.

For funeral homes wishing to provide guest replay access while reducing copyright risk. This is Foveo’s default option.

  • Identified copyrighted music in the recording is automatically muted. Spoken portions of the service, including eulogies, readings, tributes, prayers, and remarks, remain available.
  • Music selections are shown in an accompanying interactive guide so guests understand what was played during the service.
  • Guests unable to attend the live broadcast can still experience the substance, meaning, and flow of the service.

For funeral homes wishing to allow limited guest access to original-format funeral recordings.

  • Recordings include the full audio captured during the service and may include musical selections that are subject to additional copyright licensing or other applicable rights.
  • Funeral homes are responsible for determining whether their selected recording settings are appropriate for their licenses, permissions, policies, and legal obligations.

For funeral homes that prefer not to offer guest replay access or manage guest access to recordings.

  • Guests may attend the livestream broadcast, but the recording is not posted for replay afterward.
  • This option may also be appropriate when a family wishes to limit access or keep the recording private.

Private Family Access

Funeral recordings often become treasured family keepsakes and part of a family’s history. Foveo allows you to manage family access separately from guest access. Family access is private and intended to preserve a personal archival copy of the service recording for remembrance and family history purposes.

Your funeral home can choose to grant private, secure access to one family member so they can download a personal copy of the service recording, subject to your selected settings and any applicable rights or permissions.

The Tools to Manage Recording Access Responsibly

Foveo’s Funeral Experience Platform™ makes it easy to livestream and record funeral ceremonies and manage access to recordings. With configurable settings, guest access limits, and a standard music-muted replay option, you get the tools and flexibility you need to decide how recordings should be presented, according to the circumstances of the service, your permissions, and the approach you choose.

Important:
Foveo does not provide legal advice and does not guarantee that any particular recording setting satisfies a funeral home’s copyright obligations or obtains any required music rights or permissions. Funeral homes should consult their legal counsel, licensing provider, funeral association, or music rights advisor if they have questions about their obligations.
